Overview
This Returns, Refunds & Right of Withdrawal Policy applies to purchases made through this website.
VTEC Performance operates from Ireland and sells new, used, and second-hand automotive parts.
Used and second-hand automotive parts are sold under strict conditions because they are not new parts and may show signs of previous use, age, storage, removal, wear, cosmetic marks, or other normal used condition.
This policy explains our position on returns, refunds, used parts, new parts, compatibility, shipping damage, and statutory consumer rights.
Nothing in this policy is intended to limit or exclude any statutory rights that consumers may have under applicable Irish or European Union law.
Consumer Sales and Business / Trade Sales
Different rules may apply depending on whether the customer is buying as a consumer or as a business/trade customer.
A consumer is a person buying goods mainly for personal use, outside their trade, business, craft, or profession.
A business or trade customer is a person, company, workshop, garage, mechanic, reseller, trader, or other buyer purchasing goods for business, resale, repair, commercial, or professional purposes.
Where a purchase is made by a business or trade customer, statutory consumer withdrawal rights do not apply. Unless otherwise agreed in writing, business or trade sales are final once the order is confirmed and paid.
No Voluntary Returns on Used or Second-Hand Parts
VTEC Performance does not offer voluntary returns, refunds, or exchanges on used or second-hand parts for change of mind, incorrect part ordered, buyer error, misdiagnosis, incompatibility with the customer’s vehicle, failure to check part numbers, engine codes, gearbox codes, chassis details or specifications, labor costs, fitting costs, coding costs, diagnostic costs, other related costs, or issues caused by incorrect installation, modification, misuse, or damage after delivery.
Used and second-hand parts are sold according to the product listing, description, photographs, and information provided at the time of sale.
For business or trade customers, all used and second-hand parts are final sale unless VTEC Performance has expressly agreed otherwise in writing or the item is proven to have been incorrectly supplied or materially not as described.
For consumers, this no voluntary returns policy applies except where a mandatory statutory consumer right applies under Irish or European Union law.
EU / Irish Consumer Right of Withdrawal
Where applicable, consumers buying online may have a statutory right to withdraw from eligible purchases within 14 days without giving a reason.
For goods, the 14-day withdrawal period normally begins on the day the customer, or a person nominated by the customer, receives the goods.
To exercise this right, the customer must inform us of their decision to withdraw within the applicable withdrawal period.
Customers may do this by using the withdrawal/cancellation function available on our website, where applicable, or by contacting us using the contact details provided on our website.
Once the customer has notified us that they wish to withdraw, the goods must be returned without undue delay and no later than 14 days from the day the customer informed us of their decision to withdraw.
Unless we have agreed otherwise, the customer is responsible for the direct cost of returning goods where the return is based on change of mind or statutory withdrawal.
Refunds for eligible withdrawals will be processed in accordance with applicable law. We may withhold the refund until we have received the returned goods or until the customer provides evidence that the goods have been sent back.
Refunds for eligible withdrawals will include the price paid for the goods and the standard delivery cost originally paid, where required by law. Any additional cost for express, upgraded, or premium delivery will not be refunded unless required by law.
Goods must be returned in the same condition as received.
Customers may be responsible for any reduction in value caused by handling the goods beyond what is necessary to inspect their nature, characteristics, and functioning.
Used Parts and the Right of Withdrawal
Used and second-hand parts may be inspected by the customer in the same way they would reasonably inspect the item in a shop.
The right of withdrawal does not give the customer the right to fit, install, code, modify, dismantle, paint, repair, damage, use, test under load, or otherwise alter the part and then return it as if it were unused.
Where a used or second-hand part has been fitted, installed, coded, modified, damaged, dismantled, painted, repaired, used beyond reasonable inspection, or returned in a different condition than received, VTEC Performance may refuse the return or reduce the refund to reflect the reduction in value, where permitted by law.
This section does not affect any statutory rights that consumers may have where goods are faulty, damaged, incorrectly supplied, or materially not as described.
Exceptions to the Right of Withdrawal
The statutory right of withdrawal does not apply where an exemption under applicable law exists.
This may include, where applicable, goods that are made to the customer’s specifications, clearly personalized, or otherwise exempt under applicable consumer law.
Nothing in this section affects any rights a customer may have where goods are faulty, damaged, incorrectly supplied, or materially not as described.
Condition of Used and Second-Hand Parts
Used and second-hand automotive parts are not new parts.
Used parts may show signs of age, wear, cosmetic marks, corrosion, discoloration, previous installation, previous removal, storage marks, oil residue, surface rust, fading, scratches, dents, or other signs of prior use.
These characteristics do not automatically mean the part is defective.
The price of a used or second-hand part reflects its used condition.
Customers are responsible for reviewing the product listing, photographs, description, part number, specification, and condition before purchase.
It is the customer’s responsibility to ensure that the part is suitable and compatible with their specific vehicle, engine code, gearbox, chassis, model year, market version, trim level, or modification level before placing an order.
We strongly recommend that customers confirm compatibility with a qualified mechanic, technician, or specialist before ordering.
Any known major defects will be stated where reasonably identifiable.
Electrical, Electronic and Mechanical Parts
Used electrical, electronic, and mechanical parts may have an unknown service history unless expressly stated otherwise in the product listing.
Unless specifically stated in the product listing, used electrical, electronic, and mechanical components are not sold with any commercial warranty or guarantee regarding lifespan, performance after installation, coding compatibility, suitability for modified vehicles, or future reliability.
This may include ECUs, sensors, switches, wiring, modules, relays, pumps, engines, gearboxes, turbochargers, alternators, starters, distributors, throttle bodies, ABS units, air flow meters, instrument clusters, and other used mechanical, electrical, or electronic components.
Installation should only be carried out by a suitably qualified person.
Damage caused by incorrect fitting, incorrect coding, incorrect diagnosis, customer error, misuse, modification, poor installation, or use in an unsuitable vehicle is not covered by this policy.
Nothing in this section affects any statutory rights that consumers may have where a product is faulty, incorrectly supplied, or materially not as described.
Faulty, Damaged, Incorrect or Not as Described Goods
If a customer believes an item is faulty, damaged, incorrect, or materially not as described, they must contact us as soon as possible using the contact details provided on our website.
Customers may be asked to provide supporting information, including the order number, clear photographs of the item, clear photographs of the packaging, details of the issue, vehicle make, model, year, engine code, gearbox code, chassis details and registration where compatibility is relevant, and confirmation of whether the item has been fitted, tested, altered, coded, modified, repaired, dismantled, painted, or installed.
Customers should not install, modify, dismantle, code, paint, repair, or alter an item if they believe it may be incorrect, damaged, faulty, or not as described, unless VTEC Performance has first confirmed this in writing.
Where an issue is caused by incorrect installation, incorrect diagnosis, buyer error, misuse, accidental damage, modification, normal wear and tear, or incompatibility with the customer’s vehicle, a refund or replacement may not be available.
This does not affect any mandatory rights available to consumers under applicable law.
Compatibility and Buyer Responsibility
Automotive parts can vary depending on model year, market, engine code, gearbox, chassis number, trim level, emissions equipment, manufacturer updates, and prior vehicle modifications.
The customer is responsible for checking compatibility before purchase.
Any compatibility advice provided by VTEC Performance is given in good faith based on the information available at the time.
Final responsibility for confirming compatibility remains with the customer unless VTEC Performance has expressly confirmed in writing that a specific part is guaranteed to fit a specific vehicle.
VTEC Performance is not responsible for labor costs, diagnostic costs, fitting costs, coding costs, recovery costs, storage costs, loss of use, loss of earnings, vehicle downtime, or other consequential costs unless required by law.
Shipping, Delivery and Transit Damage
All items are packaged with reasonable care before dispatch.
For consumer sales, risk normally passes to the customer when the goods are delivered to the customer or to a person nominated by the customer.
For business or trade sales, unless otherwise agreed in writing, risk may pass once the goods are handed to the courier or delivery provider.
If an item arrives damaged, customers must contact us as soon as possible, preferably within 24 hours of delivery, so that we can review the issue and raise a courier claim where applicable.
Customers must keep all packaging and provide clear photographs of the external packaging, internal packaging, shipping label, damaged item, and any visible damage or missing contents.
Failure to provide evidence may affect our ability to investigate the issue or make a claim with the courier.
Nothing in this section limits any statutory rights that consumers may have under applicable law.
Return Process
Before returning any item, customers must contact us or use the withdrawal/cancellation function available on our website, where applicable.
Returns must not be sent back without contacting us first.
Returns must be sent to the return address provided by VTEC Performance after the return request has been reviewed.
Items must be returned securely packaged and protected from damage during transit.
The customer is responsible for ensuring that returned goods are properly packaged. We recommend using a tracked and insured delivery service.
Unless we have agreed otherwise, the customer is responsible for the return shipping cost for change-of-mind returns or statutory withdrawal returns.
Return shipping costs may be handled differently where goods are faulty, damaged, incorrectly supplied, or materially not as described, in accordance with applicable law.
Unauthorized returns, returns sent to the wrong address, or returns sent without sufficient information may be delayed or refused where permitted by law.
Refused Deliveries and Failed Delivery Attempts
If a delivery is refused, not collected, or returned to us due to incorrect address details, failed delivery attempts, or customer non-collection, we may deduct reasonable delivery, return, storage, or handling costs from any refund, where permitted by law.
This does not affect any statutory rights that consumers may have under applicable law.
New Parts
New parts are not covered by the strict used-parts final sale position.
New parts may be covered by manufacturer warranty, supplier warranty, or specific warranty terms stated on the product listing.
Any manufacturer or supplier warranty is separate from, and does not replace, any statutory rights available to consumers under applicable law.
If a new part is believed to be faulty, damaged, incorrect, or not as described, customers should contact us as soon as possible with their order number and supporting evidence.
Special Order, Custom, Personalized or Non-Standard Items
Some items may be specially sourced, customized, modified, or supplied to a customer’s specific requirements.
Where an item is made to the customer’s specifications, clearly personalized, or otherwise falls within a legal exemption, the statutory right of withdrawal may not apply.
Customers will be advised where specific terms apply to a special order, custom, personalized, or non-standard item.
Nothing in this section affects any statutory rights that consumers may have where goods are faulty, damaged, incorrectly supplied, or materially not as described.
